By using colab.com.br, the user adheres to the terms set forth herein and agrees to be fully bound by the conditions mentioned below.

 

## 1. about the service

 

colab.com.br, COLAB TECNOLOGIA E SERVIÇOS DE INTERNET S/Aregistered with the CNPJ/MF under no. 19.381.604/0001-53, with headquarters and registered office at Rua Pamplona, no. 1005, Jardim Paulista, São Paulo-SP, CEP 01.405-200, is a platform and social network that enables social interaction between the user and the Government, aimed at exercising citizenship, with the objective of connecting citizens to services of collective interest in a transparent manner and with a focus on solving problems, discussing projects and evaluating public services. The structure of colab.com.br is made up of an environment for interaction between users, via the web and smartphone applications, and a second administrative environment, in which a public entity or body, concessionaires or civil society organizations can manage citizen demands in a practical and intelligent way, submitting such initiatives to the respective managers.

 

## 2. Settings

 

For the purposes of this instrument:

 

  1. a) User: any natural person who uses the colab.com.br applications, with a registered profile (for interaction), or without registration (for consultation and viewing only);
  2. b) Public Services: set of activities carried out by the State, directly or indirectly, for the benefit of citizens and the community.

 

  1. c) Platform: the virtual environment of the colab.com.br application and/or website that enables the use of the services offered;
  2. d) Publication registration: the complete procedure for the publication of an inspection, proposal or evaluation by a colab.com.br user, provided that all the stages of the procedure have been complied with;
  3. e) Compulsory registration data: personal data strictly necessary to fulfill the purpose of colab.com.br provided by users when registering, in both app and web versions: Name to identify the user; CPF/MF to validate the user's existence; E-mail for communication and operationalization of collaborative public management with the user; Date of birth for user engagement; City to route content targeted to the user's possible interest; Password to guarantee user access to the platform's services; 

 

  1. f) Optional personal registration data: photograph (does not need to be your facial biometrics) to identify your profile; geographic location data to allow targeting of options for exercising citizenship in the place where the user is located, bank details exclusively in the "Qualified, Won Program!Program" to receive credits in the event of winning; Gender to route targeted content and enable improvements to the platform through the generation of anonymized reports and statistical data; Neighborhood (exclusively in the web version) to route targeted content and enable improvements to the platform through the generation of anonymized reports and statistical data; Education level (exclusively in the web version) to route targeted content and make it possible to improve the platform by generating anonymized reports and statistical data; Real estate registration and/or sequence (exclusively in the app version) of the property if interested in making or consulting payment methods; Credit card number (exclusively in the app version) if interested in paying IPTU by credit card in the app.  

 

  1. f) Public information: non-individualized and non-confidential information, the disclosure of which is made possible through the colab.com.br website (inspection report, response from the public service provider, etc.);
  2. g) Confidential information: personal data or any other information whose confidential nature derives from the law or from decisions handed down by an administrative and/or judicial body.

 

## 3. the types of service

 

colab.com.br offers the following services:

 

  1. a) Registration of inspections, proposals and evaluations by users in relation to public services carried out, directly or indirectly, by federal, state, municipal and/or district entities, observing the rules and definitions contained in colab.com.br;

 

  1. b) Visualization of the data and information collected from the publications registered on colab.com.br by users, with the exception of personal and confidential data;

 

  1. c) Participation in polls proposed by the colab.com.br team or by federal, state, municipal and/or district entities, always observing the rules and definitions of colab.com.br;

 

  1. d) Delivery of alerts and/or relevant information to the user via e-mail and/or push notifications on smartphones. Alerts and/or information may originate from colab.com.br or from federal, state, municipal and/or district entities, directly or indirectly, always observing the rules and definitions of colab.com.br;

 

  1. e) Payment of real estate property tax by downloading the bank slip to be made available on the platform, inserting the PIX key and/or including credit card details.

 

## 4. The use of colab.com.br

 

Access to colab.com.br is available to duly registered users:

 

  1. a) Record inspections, proposals and evaluations directed at the entities responsible, directly or indirectly, for providing public services;

 

  1. b) Monitor the progress of its inspections, proposals and recorded assessments;

 

  1. c) Interact with the entity responsible, directly or indirectly, for providing public services, through a channel specially created so that additional information can be entered, with the aim of obtaining an effective and efficient resolution of the demand presented;

 

  1. d) Comment on and evaluate inspections, proposals and evaluations by other users of the platform.

 

  1. e) Participate in polls and consultations initiated by colab.com.br or public bodies.

 

  1. f) Make or consult other forms of municipal tax payment, such as IPTU. 

 

## 5. conditions of use of colab.com.br

 

  1. a) All users registered on colab.com.br must be natural persons who are data subjects, identified in accordance with the law.

 

a.1) Profiles identified using personal data that does not refer to the person of the user, verified and identified by the criteria established by colab.com.br, will be excluded.

 

  1. b) All publications on the platform must be aimed exclusively at improving cities and public services.

 

b.1) Publications will be excluded if they do not comply with the conditions below:

 

b.1.1) The published image must be a photograph taken by the user; 

 

b.1.2) The image published must be related to the category of the publication and may be excluded at the discretion of colab.com.br if it does not refer to that category;

 

b.1.3) The text of the publication must be related to the proposed context, by providing relevant information on the topic;

 

b.1.4) The location of the publication must be accurate;

 

b.2) Any user can mark posts as inappropriate.

 

b.2.1) Inappropriate publications are those that violate the terms of use, as well as those that contain inappropriate, disrespectful, racist, prejudiced, illegal, immoral language and/or contain unauthorized personal data of third parties, such as license plates and facial biometrics;

 

b.2.2) Posts deemed inappropriate are reviewed by the colab.com.br team and, if they do not comply with these terms of use, will be removed at the sole discretion of colab.com.br;

 

  1. c) Site users may not:

 

c.1) Enter false and/or erroneous information on the platform; use false computer, network or e-mail addresses; use false personal data and/or data that does not refer to him/her; use partially or entirely false information, or information whose origin cannot be verified;

 

c.2) Use the colab.com.br services for purposes other than those of the website;

 

c.3) Use, in the field for attachments, files containing computer viruses, invasive or destructive content or that cause temporary or permanent damage to the recipient's equipment and/or colab.com.br, or materials protected by intellectual property or commercial secrecy, except in cases where the uploader is the holder of these rights;

 

c.4) Use illegal, aggressive, slanderous, abusive, defamatory, obscene, invasive of the privacy of third parties, against good customs, morals or contrary to public order in the fields intended for filling in texts;

 

c.5) Registering or publishing using data or identifying themselves as a third party without the latter's authorization;

 

c.6) Entering personal information or any other information that in any way allows the identification of information protected by confidentiality in the public disclosure fields;

 

c.7) Altering, deleting and/or corrupting data and information on the website for the sole purpose of hindering or obstructing the registration and/or resolution of the claim;

 

c.8) Defame, abuse, harass, stalk, threaten or violate any individual rights (such as the privacy of system users);

 

c.9) Promote, offer and/or disseminate advertising, offers of products or services of any kind;

 

  1. d) The user's obligations are:

 

d.1) Provide its own Internet access and pay any Service fees charged by third parties in relation to such access;

 

d.2) Provide its own access to an address for sending electronic messages via the Internet and pay any Service fees charged by third parties in relation to such access;

 

d.3) Provide all the equipment necessary to connect to the Internet, including, but not limited to, a computer and a modem;

 

d.4) Register themselves on the Site, taking responsibility for the correctness and veracity of the data provided, as well as for the safekeeping of their access password;

 

d.5) Keep your computer environment secure, using up-to-date tools such as antivirus and firewall, among others, in order to help prevent electronic risks on the USER's side.

 

The practice of any of the misconducts listed above may result in the cancellation of the publication and/or the user's registration.

 

## 6. Privacy of Our Users and Visitors

 

We have an express policy on Online Privacy. Registration information and certain other information about the user, such as the use of data related to the user's location, is subject to the treatment defined in this policy. For more information, please consult the "Privacy Policy" document available at "http://www.colab.com.br" on the AdOpt cookie control platform located at the bottom left of the computer screen. This document forms an integral part of the Terms and Conditions of Use of the Site and should be read carefully by all USERS before accepting and using the Site.

 

## 7. Use of the Portal and its Links

 

Under no circumstances will we be held responsible for the use of our Site or access to links indicated on it, as well as for acts carried out by users based on information obtained from the links. We are not responsible for the content or the privacy policies/practices of the portals that link to our Site or those to which we link. 

The user assumes any and all liability, of a civil and/or criminal nature, for the improper use of the information, texts, graphics, trademarks, works, in short, any and all intellectual or industrial property rights of this Site.

 

## 8. User Registration, Password and Security

 

In order for USERS to be able to enjoy the benefits provided by the Site, which is the object of this term, it is necessary for them to have previously registered on the Site or in the Application available for smartphones. 

 

The USER, in these Terms of Use, agrees to:

 

(a) provide true, accurate, current and complete information about themselves when registering on the specific form for access to the Site;

 

(b) maintain and promptly update such Registration Information to keep it true, accurate, current and complete.

 

The USER must provide his/her own e-mail address to be used to identify him/her on the http://www.colab.com.br website and/or in the application in order to receive messages from his/her registration. The USER must also create a password, and is entirely responsible for the confidentiality of their password, as well as any activity that takes place within the scope of their registration. The USER can change their password at any time. Both the e-mail address provided by the USER and the password they have created will be used to identify them and allow them to access the Site. Users under the age of 18 (eighteen) or legally incapable must be represented or assisted, as the case may be, by their parents or legal guardians when registering and using the site and/or application.

 

USER Account Information is password protected for your security and privacy. In some areas, we use SSL encryption, the industry standard, to protect data transmissions.

 

The USER agrees to immediately notify colab.com.br via contato@colab.com.br of any unauthorized use of their login (identification of the USER for access to the Site, by filling in their personal e-mail address and password created on the Site) or any breach of security of which they are aware. You also agree not to leave your personal record open on your computer after entering your e-mail address and password on the Site, thus avoiding unauthorized use by third parties. 

It is our policy to respect the privacy of our USERS. The Site will not, therefore, monitor, edit, access or disclose private information of its USERS, without prior authorization, except in the cases expressly provided for in the terms of the Privacy Policy or unless we are obliged to do so by court order or by force of law. 

The USER expressly authorizes colab.com.br to communicate with the USER through all available communication channels, including electronic mail (e-mail), cell phone, SMS, among others that may be informed by the USER, it being emphasized that the main means of information for the USER is the Website or the Smartphone Application.

At any time, the USER may delete their account, along with all their registration data, and colab.com.br is allowed to store it with the authorization of Law No. 13,709/2018 (General Law on the Protection of Personal Data), in which case all technical and administrative measures for information security and privacy will be applied.

colab.com.br will be allowed to use the database generated from the execution of the services in an anonymized way, i.e. without identifying the data subjects, and within the limits set out in the General Personal Data Protection Law, for the improvement of the services performed, evolutionary customization of the platform, development of surveys, statistical information, performance reports and management procedures.  

 

## 9. Modifications to these Terms and Conditions

 

colab.com.br reserves the right to modify these Terms and Conditions of Use at any time, with a view to continuous improvement, and to provide ample prior notice of such changes to users of the service.

 

## 10. Exclusion of Guarantees and Liability

 

As a result of operational issues, outsourcing of services, the Site, the Smartphone Application and the Services are subject to possible interruption, technical failure or temporary unavailability. Where reasonably possible, the colab.com.br site and/or application will give prior notice of interruptions to the operation of the Site/Application and the Services to its USERS.

 

colab.com.br disclaims, to the fullest extent permitted by law, any liability for damages of any kind that may arise from the lack of availability or continuity of operation of the website and services, the failure of users to make use of the website and services, the failure of the website and services and, in particular, although not exclusively, the failure of access to the various web pages that make up the website or where the services are provided.

 

## 11. General Provisions

 

Tolerance of any breach of any of the clauses and conditions of this contract shall not constitute a novation of the obligations stipulated herein, nor shall it prevent or inhibit their enforceability at any time.

 

This instrument constitutes the entire agreement between the parties and shall prevail over any other understanding previously entered into.

 

This term will be in force for an indefinite period of time or for as long as the system is available via the Internet.

 

## 12. Applicable legislation

 

These Terms of Use are governed solely and exclusively by the laws of the Federative Republic of Brazil and any legal dispute arising from their interpretation or application shall be heard by Brazilian courts, and the courts of the city of São Paulo, State of São Paulo, are hereby elected, however privileged they may be or may become.

ANY PERSON, NOW REFERRED TO AS "USER", WHO INTENDS TO PARTICIPATE IN THE "Qualified, Won! Program", MUST ACCEPT THESE "TERMS AND CONDITIONS OF USE". 

 

BY REGISTERING, THE USER IS DECLARING THAT THEY ARE OF LEGAL AGE, EMANCIPATED OR BEING REPRESENTED BY A CAPABLE PERSON AND THAT BOTH ENJOY FULL CIVIL AND CRIMINAL CAPACITY.

 

IN ADDITION, BY CLICKING ON THE "I ACCEPT" BUTTON, YOU ARE DECLARING THAT YOU HAVE READ AND ACCEPTED IN FULL, WITHOUT ANY CLAIMS, THIS "TERMS AND CONDITIONS OF USE", WHICH ESTABLISH THE RULES AND REQUIREMENTS OF THE "Qualified, Won!" ADHESION TO THE "Qualified, Earned Program!" AND ITS BENEFITS ARE PROVIDED AT THE EXCLUSIVE CRITERIA OF COLAB TECNOLOGIA E SERVIÇOS DE INTERNET S.A., REGISTERED IN THE CNPJ UNDER No. 19.381.604/0001-53 (NOW REFERRED TO AS "COLAB"), WHICH RESERVES THE RIGHT TO CHANGE THE RULES AND REQUIREMENTS OF THE "Qualified, Won! Program" AT ANY TIME, IN WHOLE OR IN PART, BY MEANS OF PRIOR NOTIFICATION SENT TO USERS, IN THE MANNER DESCRIBED IN THESE "TERMS AND CONDITIONS OF USE". 

 

  1. INTRODUCTION

 

1.1.. One of Colab's main objectives is to promote a bridge between citizens and the municipality. In order to facilitate this communication, Colab has developed the "Qualified, Won! Program" and included it in its smartphone app - "Colab", which is the essential vehicle for joining the "Qualified, Won! Program" and carrying out communications and any qualifications. 

 

1.2 This instrument establishes the relationship with the Users participating in the "Qualified, Won! Program", agreeing on the rules and requirements for use and liability of each party, in accordance with Brazilian law, including provisions of Law No. 12,965/2014 ("Marco Civil da Internet"), Law No. 8,078/1990 ("Consumer Protection Code") and Law No. 13,709/2018 ("General Personal Data Protection Law).

  1. DIFFERENTIATION BETWEEN THE COLAB PLATFORM/APP AND THE "Qualified, Earned Program!"

 

2.1 Colab is a platform and social network for citizens, in which citizens can, among other actions, collaborate by reporting urban cleaning incidents in cities, adding a detailed location and description. Posts are free and do not receive any remuneration - other than a score within the "Colab" application itself - in return. 

 

2.2. The "Qualified, Won! Program" is a qualification program that arises as an exclusive initiative of Colab, and the participating User can contribute by sending information and/or images, as requested, respecting the guidelines previously made available and according to the geographical location indicated., The User can contribute by sending information and/or images, as requested, in compliance with the guidelines previously provided and in accordance with the geographical location indicated. In return for the contribution made, a financial or non-financial reward may be offered, as per item 3.2 below. In this way, occurrences are only considered to have been qualified once there has been a response (with information and/or images) to a previous request, whereas on the Colab social network, described in item 2.1 above, posts can be made by any user, at any time, at their sole discretion and convenience.

 

2.3 Qualifications for events under the "Qualified, Earned! Program" will be available on the specific tab within the map in the Colab app. 

 

  1. HOW THE "Qualified, Earned Program!" WORKS

 

3.1. Before I begin to explain how the procedure for qualifying occurrences works within the "Qualified, Won! Program", it is important to ratify, as seen in items 2.1 to 2.3 above, that the tasks available in the Colab application do not offer any kind of financial compensation, but are only intended to engage participants in the platform.

 

3.2 Qualifications under the "Qualified, Won! Program" that may be entitled to financial or non-financial compensation will be duly flagged, and when financial compensation is applicable, with the corresponding amount, which may vary between R$ 5.00 (five reais) and R$ 50.00 (fifty reais), depending on the complexity and criteria stipulated by Colab.

 

3.3 The occurrence qualifications - whether those that give rise to financial or non-financial rewards - of the "Qualified, Won! Program" will only appear to participating Users after they have read and accepted these "Terms and Conditions of Use".

 

3.4 In order to carry out an occurrence qualification, available in the relevant tab within the map in the Colab application, the participating User must read the instructions, go to the address indicated, take the requested photos and/or provide the requested information, answer the questions and finalize the submission within the Colab application.

 

3.5. Once the submission has been completed, it will be checked whether the information and/or images requested have been sent correctly and, if so, the qualification of the event will be considered to have been carried out and validated, and the participating User may be entitled to the financial compensation previously informed in the qualification, which will be communicated by means of a message sent to the registered e-mail address, subject to the provisions of item 3.6 below.

 

3.6. From the date of completion and validation of the occurrence qualification, Colab will have up to 10 (ten) working days to contact the participating User via the e-mail address provided in the registration, and request the necessary data to make the financial retribution, if applicable.

 

3.7. The data used to contact the participating Users will be those provided, and presumed to be correct, when registering for access to Colab and the "Qualified, Won! Program".

 

3.8. Once the Participating User has replied with the requested data, Colab will have a further 10 (ten) working days to make the previously informed financial payment, which will be made by bank transfer to an account held by the Participating User, with the bank transfer receipt serving as proof of payment.

 

3.8.1. On a case-by-case basis, Colab will contact the participant within 10 working days of validating the qualification to inform them of each step.

 

3.9. Colab will not be held responsible under any circumstances for information submitted incorrectly by participating Users. If the data is not correct, there will be no charge, penalty or liability for Colab.

 

  1. THE USE OF COLAB and the "Qualified, Won! Program" BY PARTICIPATING USERS

 

4.1. The participating User is responsible for the correct use of the Colab application and its available services, always with unrestricted respect for the law, good customs and this instrument, when using the "Qualified, Won! Program" to carry out an occurrence qualification, being entirely responsible for their actions.

 

4.2 In the Annex to this instrument, Colab exemplifies possible risks and presents preventive control measures that must be followed by participating Users when carrying out event qualifications, when using the "Qualified, Won! Program".

 

4.3. The participating User declares that he/she is aware of the Annex mentioned in item 4.2 above, and therefore undertakes to avoid any risk to his/her health and integrity, and Colab shall not be held liable for any such acts.

 

4.4. Participating Users are strictly prohibited from using content that is libelous, pornographic, insulting, defamatory or that violates the rights of minors, and are therefore liable for any damage of any kind that Colab or any other User or third party may suffer as a result of such acts.

 

4.5. Colab will not at any time be a party to any conflict that may arise between participating Users or between the participating User and any third party that may hinder the proper functioning of the Colab application. Until the situation is resolved, Colab may, at its sole discretion, suspend and/or remove such Users from its database, and will assess, on a case-by-case basis, the deletion of any offensive comment present in the Colab application.

 

4.6. At any time and without prior notice, if any User uses the Colab application or the "Qualified, Won! Program" incorrectly, in such a way as to disrespect the general conditions of use, and commits fraudulent or malicious acts, at Colab's sole discretion, they may be subject to refusal of access to the Colab application for an indefinite period, by means of a respective notice in their registration.

 

4.8. By having their account suspended or canceled, Users will also have their registration information suspended or canceled, and a notice that they are no longer part of Colab may also be included in their registration.

 

4.7. Colab reserves the right to terminate the "Qualified, Won! Program" at any time, without prior notice, and without this entailing any charges and/or penalties.

 

  1. PRIVACY POLICY FOR USERS' PERSONAL DATA

 

5.1. Participating Users will be fully responsible for the information and data provided to Colab, and Colab will not be held liable for the veracity of the data and information provided. The User must complete the registration form with accurate, precise and truthful information and undertakes to update personal data whenever any changes occur.

 

5.2 Colab shall, however, protect the confidentiality of information and registrations relating to Users by storing them on servers or any other secure magnetic medium.

 

5.3 Colab may use some information provided by Users in the Colab application (except for Users' Personal Data), but this will be limited to the promotion of the Colab application or the "Qualified, Won! Program", whether in the form of comments about Colab, the application or the "Qualified, Won! Program", User evaluations, or just numerical and aggregate data regarding the use of the Colab application and its functionalities.

 

5.4 Users' Personal Data, such as name, e-mail address, etc., may be used by Colab to send notifications, information about the account or services provided, warnings about violations of this instrument and other communications it deems necessary. Participating Users may ask Colab to remove them from the mailing list at any time.

 

5.5 Only in the event of a judicial, arbitral or administrative request, Colab will report the information of its Users to the authorities, to the extent necessary to comply with the request.

 

5.6. Colab will take all possible measures to maintain the confidentiality and security described in this item, but at no time can it be held responsible for any damage that may occur due to the violation of these measures by third parties who use improper and illicit means to access information stored in its database.

 

5.7. Colab shall process the Personal Data of Users that it has access to as a result of accepting these "Terms and Conditions of Use", solely and exclusively for the purposes of participation in the Colab application and "Qualified, Won! Program", with colab.com.br being allowed to store it by legal authorization, in which case all technical and administrative measures for information security and privacy purposes shall be applied.

According to items 4.2 and 4.3 of the "Terms and Conditions of Use | Qualified, Won! Program", Colab exemplifies possible risks and presents in a preventive manner possible control measures that must be followed by participating Users when carrying out the qualifications of occurrences, when using the "Qualified, Won! Program":
